Terms and Conditions for Gulf Music Sales

Welcome to Gulf Music Sales! These Terms and Conditions ("Terms") govern your use of our website and the purchase of our accordions. By accessing our website and placing an order, you agree to be bound by these Terms. Please read them carefully.

Gulf Music Sales is a business based in California, United States, selling and shipping accordions across the United States.

1. Website Use and Content

You are granted a limited license to access and make personal use of this website. You may not download (other than page caching) or modify it, or any portion of it, except with express written consent from Gulf Music Sales. This license does not include any resale or commercial use of this site or its contents. All content on this website, including text, graphics, logos, images, and software, is the property of Gulf Music Sales or its content suppliers and is protected by United States and international copyright laws.

2. Product Descriptions and Availability

We strive to be as accurate as possible in our product descriptions. However, Gulf Music Sales does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.

We sell both new and used accordions. The condition of each accordion will be clearly stated in its product description. We encourage you to contact us with any questions before making a purchase. All products are subject to availability, and we reserve the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue products without notice, even if you have already placed your order.

3. Pricing and Payment

All prices are listed in U.S. Dollars. We accept major credit cards and other payment methods as indicated on our website. By providing a credit card or other payment method, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and other charges).

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

4. Sales Tax

As a California-based business, we are required to collect sales tax on orders shipped to addresses within California. We also collect sales tax on orders shipped to other states as required by law. The applicable sales tax will be calculated and added to your order total at checkout.

5. Shipping

We ship accordions across the United States. Shipping costs will be calculated and displayed at checkout. All shipping dates are estimates only. We are not responsible for delays in shipping or delivery due to causes beyond our reasonable control.

Shipping Insurance: Due to the delicate and valuable nature of our accordions, all shipments are insured for their full value. The cost of this insurance is included in the shipping and handling fees. In the unfortunate event of damage during shipping, please contact us immediately to initiate a claim.

Inspection upon Delivery: It is your responsibility to inspect your order upon delivery. If you notice any damage to the packaging, please note it with the carrier and contact us within 48 hours of receipt.

6. Returns and Refunds

We want you to be completely satisfied with your purchase. If you are not, you may return your accordion within [Insert Number, e.g., 14] days of receipt for a refund or exchange, subject to the following conditions:

  • Return Authorization: You must obtain a Return Authorization (RA) number from us before returning any item. Please contact us at:

  • Condition of Returned Item: The accordion must be returned in its original, unaltered condition with all original packaging, accessories, and documentation. Used accordions must be returned in the same condition as they were sent.

  • Shipping Costs: You are responsible for all return shipping costs, including insurance for the full value of the accordion. We are not responsible for items lost or damaged during return shipping.

  • Restocking Fee: A restocking fee of 20% of the purchase price may be applied to all returns to cover inspection, cleaning, and administrative costs. For certain woodwind and brass instruments, a sterilization fee may apply.

  • Non-Refundable Items: Custom-ordered accordions and items marked as "Final Sale" are not eligible for return.

Refunds will be processed to the original payment method within 5-7 business days of our receipt and inspection of the returned item.

7. Warranty

New Accordions: All new accordions sold by Gulf Music Sales come with a manufacturer's warranty. Please refer to the manufacturer's documentation for warranty details.

 

Used Accordions: We offer a limited [Insert Number, e.g., 90]-day warranty on all used accordions. This warranty covers defects in materials and workmanship under normal use. This warranty does not cover:

  • Normal wear and tear.

  • Damage caused by misuse, neglect, accident, or improper storage.

  • Damage to reeds, bellows, or straps.

  • Any modifications or repairs not performed by Gulf Music Sales.

To make a warranty claim, please contact us with a detailed description of the issue and proof of purchase. We will, at our discretion, repair or replace the defective part or accordion. You are responsible for shipping the accordion to us for warranty service.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GULF MUSIC SALES, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE OR THE PURCHASE OF OUR PRODUCTS.

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS AND DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OUR WEBSITE OR PURCHASE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.

9. Governing Law and Dispute Resolution

These Terms and your purchase of products from Gulf Music Sales shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your purchase of products shall be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association.

10. California Consumer Rights

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA). Please review our Privacy Policy for more information on these rights and how to exercise them.
